Terms of Service

1. What NOCX AI Is

NOCX AI is an AI-powered prompt-to-print custom garment platform. You describe a design, we generate it, and it gets printed and shipped to you. Every piece is made on demand. No two pieces are ever the same.

2. Custom Orders

All orders are custom-made on demand specifically for you. Because each garment is unique and printed only after you order, we do not accept returns or exchanges unless there is a verified print defect or fulfillment error on our part. Contact us within 14 days of delivery if you believe your order has a defect.

3. Print Variability

AI-generated designs are unique to each order. Final colors, placement, and appearance may vary slightly from the on-screen preview due to monitor calibration, dye-sublimation color rendering, and fabric texture. Minor variations are not defects and are not grounds for a return.

4. Design Ownership

You own the design you create. By submitting a prompt and completing an order, you grant NOCX AI a limited, non-exclusive license to generate, composite, fulfill, and ship that specific design. We do not sell your designs to third parties or use them on other products without your permission.

5. Acceptable Use

You agree not to submit prompts or upload images that contain: hate speech, content targeting protected groups, explicit or adult material, third-party intellectual property (brand logos, trademarked names, copyrighted characters), or any illegal content. Violations may result in order cancellation without refund and account termination.

6. Age Requirement

You must be at least 13 years old to use NOCX AI. If you are under 18, you must have parental or guardian consent to place an order.

7. Payment

All prices are in USD. Your order is confirmed when payment is successfully processed and you receive an order confirmation email. We reserve the right to cancel orders that cannot be fulfilled.

8. Shipping

Orders are fulfilled by our print partner. Domestic orders typically arrive within 1–2 weeks of production and standard transit combined; some products may take longer. This is an estimate only, not a guarantee. International orders may take longer. NOCX AI is not responsible for delays caused by carriers, customs, or events outside our control. International orders may be subject to customs duties and taxes, which are the buyer's responsibility.

9. Limitation of Liability

To the maximum extent permitted by law, NOCX AI is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of our platform or your order — including the Marketplace and any design listed, bought, or sold through it. Our total liability for any claim is limited to the amount you paid for the specific order in dispute.

10. Updates to These Terms

We may update these Terms from time to time. We will notify you of significant changes via email or a notice on the site. Continued use of NOCX AI after changes are posted constitutes your acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

12. Creator Rewards Program

NOCX AI offers a creator rewards program that allows designers to earn credits when other users purchase their listed designs. These credits are discretionary and are redeemable for third-party promotional rewards (such as gift cards) at NOCX AI's sole discretion. Credits do not represent wages, guaranteed income, or a contractual obligation of payment. NOCX AI reserves the right to modify, pause, or discontinue the rewards program at any time without notice. Credits have no cash value and are non-transferable.

13. Marketplace Listings

By listing a design on the NOCX Marketplace, you represent and warrant that you have all rights necessary to the design (including the prompt, any uploaded reference images, and the resulting AI-generated artwork) and that it does not infringe, misappropriate, or otherwise violate any third party's intellectual property, publicity, privacy, or other rights, and that it complies with our Acceptable Use policy (Section 5).

You grant NOCX a perpetual, irrevocable, worldwide, royalty-free license to use, display, reproduce, and sell that design, including after your account is closed or the underlying order is otherwise no longer active. Listed designs are permanently active on the Marketplace unless removed by you or by NOCX. Your design is listed only after your order is confirmed.

NOCX does not pre-screen every Marketplace listing for accuracy, originality, or compliance with these Terms or applicable law before it goes live. We reserve the right, but not the obligation, to review, edit, refuse, remove, or delist any Marketplace listing at any time, with or without notice, for any reason or no reason — including in response to a notice under Section 14 (Intellectual Property Claims & Takedowns).

Purchases of Marketplace-listed designs are custom orders subject to Section 2 (Custom Orders) — all sales are final except for verified print defects or fulfillment errors. NOCX is not a party to, and is not responsible for, disputes between a buyer and the creator of a listed design, including disputes over the design's originality, quality, or the accuracy of its description.

Listing a design does not entitle the creator to any guaranteed payment. Any credit earned from Marketplace activity is governed solely by Section 12 (Creator Rewards Program), which is discretionary and may be modified, paused, or discontinued at any time.

14. Intellectual Property Claims & Takedowns

NOCX respects the intellectual property rights of others and expects users to do the same. If you believe that content on NOCX AI — including a Marketplace listing — infringes your copyright, trademark, or other intellectual property rights, send a written notice to hello@nocx.studio that includes:

• A description of the copyrighted work or other intellectual property you believe has been infringed;
• The specific URL or listing where the allegedly infringing material is located;
• Your contact information (name, address, phone number, email);
• A statement that you have a good-faith belief the use is not authorized by the rights holder, its agent, or the law; and
• A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the rights holder or authorized to act on their behalf.

Upon receiving a valid notice, we may remove or disable access to the reported content and will make reasonable efforts to notify the affected user. We reserve the right to terminate, without notice, the account of any user found to repeatedly infringe the intellectual property rights of others.

15. Indemnification

You agree to indemnify, defend, and hold harmless NOCX AI, its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your prompts, uploaded images, or Marketplace listings; (b) your violation of these Terms, including the Acceptable Use policy; or (c) your violation of any third party's rights, including intellectual property rights.

16. Disclaimer of Warranties

NOCX AI, our AI-generated designs, and the Marketplace are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that AI-generated designs, or any design listed by another user on the Marketplace, are free of third-party intellectual property claims, that the platform will be uninterrupted or error-free, or that any defect will be corrected.
